This Privacy Policy ("Policy") describes how AYAN TECHNOLOGIES & CONSULTING LLC, the provider of Planewise ("Ayan Technologies & Consulting," "Planewise," "Company," "we," "us," or "our"), collects, uses, shares, and protects information in connection with the Planewise software-as-a-service platform, including the web application, mobile applications, and related services (collectively, the "Service"). This Policy is incorporated into and forms part of the Planewise Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
By accessing or using the Service, you ("User," "you," or "your") agree to the collection, use, and processing of information as described in this Policy. If you have entered into a separate signed Software Subscription Agreement with Company, the data-handling terms of that agreement govern and control to the extent of any conflict with this Policy as to the parties to it.
1. Information We Collect
We collect the following categories of information. Note that the specific data you provide depends on how you use the Service.
Information you provide:
- Account and contact information: first name, last name, email address, and, if provided, Organization name, email, and phone number.
- Communications you send to us, such as support requests and feedback.
Service and operational data:
- Aircraft information, such as tail numbers, make and model, properties, and base airport.
- Squawks and tickets, including descriptions, severity, status, and comments.
- Photographs and other files you attach to tickets or records.
- Inspection and maintenance data, including inspection types, due dates, life-limited-part entries, and Hobbs/Tach values.
- Organization and membership data, including member names, roles, emails, and permission settings.
Information collected automatically:
- Device and log information, such as device type, operating system, application version, IP address, and diagnostic and usage data.
- Push-notification tokens.
- Cookies and similar technologies on the web application, used for functionality, authentication, and analytics. You can control cookies through your browser settings.
Payment information: Purchases are processed by the Apple App Store, another app store, or a third-party payment processor. We do not collect or store full payment-card numbers.
We ask that you not enter sensitive personal information about any individual, or any personal information beyond what the Service requires, into free-text fields, tickets, or attachments.
2. How We Use Information
We use information to: provide, operate, maintain, and secure the Service; create and deliver notifications, safety advisories, regulatory references, trend detections, and other outputs (including through automated and artificial-intelligence systems); communicate with you and provide support; process billing and manage subscriptions; personalize and improve the Service; monitor performance, integrity, and security; enforce our Terms of Service; and comply with legal obligations. These purposes are not exhaustive, and we may use information for other purposes compatible with those described here and permitted by law.
3. Automated Processing and Artificial Intelligence
To generate safety advisories, notifications, regulatory references, trend detections, and similar features, the Service processes your operational data — including squawk and ticket text and aircraft data — using automated systems and third-party cloud and artificial-intelligence service providers. This means relevant portions of your data may be transmitted to and processed by these providers to produce those outputs. As described in the Terms of Service, these outputs are probabilistic, may be inaccurate, and are advisory and educational only.
4. De-Identified Data
We may create data derived from your information and the operation of the Service that has been processed to remove information that could reasonably identify you, any user, or any specific aircraft or tail number ("De-Identified Data"). We may use De-Identified Data to operate, secure, analyze, and improve the Service, including its maintenance trend detection, safety analytics, and predictive and machine-learning features, and to support industry safety initiatives. This right survives termination of your account. We will not attempt to re-identify De-Identified Data except to test our de-identification processes.
5. How We Share Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only as follows:
- Within your Organization: administrators and members of your Organization may access User Content and Organization Data associated with the account, according to the roles and permissions configured for that account.
- Service providers and subprocessors: with third parties that perform services on our behalf — including cloud hosting and storage, artificial-intelligence processing, mapping and weather data, analytics, email delivery, and payment processing — who are permitted to use the information only to provide those services to us.
- Legal and safety: when we believe in good faith that disclosure is required by law, legal process, or governmental request, or is necessary to protect the rights, property, or safety of Company, our users, or others, or to enforce our agreements.
- Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case this Policy will continue to apply to the transferred information.
6. Data Retention
We retain information for as long as necessary to provide the Service and for legitimate business and legal purposes. Organization Data is generally retained for the life of the account. Following account closure or termination, we may make your data available for export for a limited period as described in the Terms of Service, after which we may delete it in the ordinary course, subject to our backup cycles and applicable legal-retention requirements.
7. Data Security
We use commercially reasonable administrative, technical, and organizational measures designed to protect information. However, no method of transmission over the internet or method of electronic storage is completely secure, and we do not and cannot guarantee absolute security. You are responsible for safeguarding your account credentials and for maintaining your own copies and backups of records you are required to keep.
8. Security Incident Notification
If we become aware of a confirmed unauthorized acquisition of, or access to, personal information in our possession or control, we will notify affected users or the relevant Organization without undue delay and, where feasible, describe the nature of the incident and the measures taken. Our obligation to notify arises only with respect to incidents of which we actually become aware, and we have no obligation to monitor for, discover, or notify you of incidents occurring on your own systems or arising from your or your users' acts or omissions. Any notice or response is not an acknowledgment or admission of fault or liability, and we may delay notice to the extent requested by law enforcement or required to protect the security of the Service.
9. Your Privacy Rights
Depending on your jurisdiction, you may have rights to access, correct, delete, or receive a copy of your personal information, and to opt out of certain processing. California residents have rights under the California Consumer Privacy Act, as amended (CCPA/CPRA), including the rights to know, access, delete, and correct personal information, to opt out of the "sale" or "sharing" of personal information (note: we do not sell or share personal information for cross-context behavioral advertising), and not to be discriminated against for exercising these rights. Residents of other U.S. states with applicable privacy laws may have similar rights.
To exercise any right, contact us at support@planewise.app. We will verify and respond as required by applicable law. Where information is submitted or controlled by an Organization, we may refer your request to that Organization's administrator, or handle it on the Organization's instructions.
10. U.S. State Privacy Laws; Service-Provider Status
To the extent any applicable U.S. state privacy law applies to personal information we process on behalf of an Organization, we act as a "service provider" or "processor" (or equivalent) and will process that personal information only to provide the Service and for the limited purposes described in this Policy and our agreements, and will not sell it or share it for cross-context behavioral advertising.
11. International Users; U.S. Processing
The Service is operated from, and information is processed and stored in, the United States, and the Service is intended for U.S.-based operations. If you access the Service from outside the United States, you consent to the transfer, processing, and storage of your information in the United States, which may have different data-protection laws than your location.
12. Children's Privacy (COPPA)
The Service is intended for aviation professionals, operators, and enthusiasts and is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act ("COPPA"). If you are an Organization and permit any individual under 13 to use the Service (for example, as part of a youth aviation program), you are responsible for providing any direct notice to, and obtaining any verifiable parental or guardian consent from, the parents or guardians of such individuals as required by COPPA, and for complying with all laws applicable to the personal information of minors. If you are a parent or guardian and believe your child under 13 has provided us with personal information without required consent, contact us at support@planewise.app, and if we become aware that we have collected such information we will take reasonable steps to delete it. If you permit individuals under 18 (but 13 or older) to use the Service, you are responsible for obtaining all consents required by law and for compliance with all laws applicable to the personal information of minors.
13. Educational Records (FERPA)
To the extent any information entered into the Service constitutes an education record subject to the Family Educational Rights and Privacy Act ("FERPA") or similar state law, we will treat that information as the Organization's data, will not use it other than to provide the Service and as otherwise permitted by this Policy (including the creation and use of De-Identified Data), and will cooperate in good faith with the Organization to handle it consistently with those laws. We ask that Organizations not enter student education records into the Service except as necessary.
14. Third-Party Links and Services
The Service may reference or link to third-party sources or services (such as regulatory sources, mapping, or weather providers). This Policy does not apply to those services, and we are not responsible for their privacy practices. We encourage you to review their policies.
15. Changes to This Policy
We may update this Policy at any time. Any changes are effective when the revised Policy is posted at planewise.app/privacy, as indicated by the "Last updated" date above. We are not obligated to provide, and generally will not provide, individual or advance notice of changes, and it is your responsibility to review this Policy periodically. Your continued use of the Service after the revised Policy is posted constitutes your acceptance of it.
